This new regulation sets in place the requirement for a three stage process for dealing with a dispute or grievance, namely:

Setting out the issue in writing; Meeting held to discuss the matter; An appeal meeting is held if the matter has not been resolved.

In addition, employees are entitled to be accompanied by a trade union official or work colleague. Any company that fails to comply with this simple process leaves itself exposed to additional financial penalties if the dispute goes to tribunal; it could render a dismissal automatically unfair, which could cost thousands.

To get your employment procedures brought up to date companies should consider advice from an employment law agency or they could consider joining EEF, the manufacturers organisation, which specialises in (amongst other things) Legal & Employment Affairs.
